AGREEMENT BETWEEN AXIS MUNDI and ELITE TRAVELER PARTICIPANTS
AXIS MUNDI ("AM"), owned by BEH llc, ...
... is only an agent for selected hotels, transport companies, land operators, and other suppliers of services. As such it is neither responsible nor liable for their operations, safety or conditions when used to provide services for AM trip members.
AM reserves the right to change times, schedules or to make select alternate lodging arrangements or transport, and in extraordinary circumstances beyond its control to require that additional costs be paid by tour members.
If any cancellation is necessary due to circumstances beyond AM's control, such as acts of God, insurrection, or strikes, refunds will be made less the cost of services provided up to that moment.
AM may accept or reject journey members at any time.
In case of medical emergency, AM will refer nearest US Embassy-certified medical services (doctors, clinics or hospitals) in localities to be visited however AM is not responsible or liable for any medical expenses that might be incurred by a participant.
AM retains the right to use its own photographic equipment to record trips and use the images in its promotional material.
ELITE TRAVELER PARTICIPANTS ...
... agree to make all travel arrangements to the required pick-up destination and all travel arrangements for departure; any delays in arrivals that may cause additional cost to AM will be billed accordingly to the respective participant.
... certify that they are fully and independently covered with travel insurance covering the travel period in question including worst case emergency evacuation.
... certify that they are in good health and will follow normal standards in protecting their hygiene so as to minimize any risks to their health; specific food requirements should be made known to eating establishments by each individual participants.
... agree to act with full consideration of their fellow travelers' privacy and rights.
... agree to abide by any posted local laws such as smoking restrictions or other regulations.
RISKS
Participants in AM journeys understand and acknowledge that a decision to participate is of their own volition and thus release AM of any liability from events that are (a) beyond the control of AM, which (b) are a result of a willful desire to participate in activities that may involve risks or (c) that may result from the negligence of third parties not of AM's choosing but that may be imposed on it by government regulations or sole providers (such as a chair lift operator).
It is acknowledged, too, that the journey host (guide) may on occasion make decisions that respond to unexpected events or that may be in answer to requests of the majority of the traveling group. These decisions may involve delays, altered schedules, changes in lodgings occasionally to a different level of lodging rating. In such cases AM will incur no liability especially when the good faith changes do not abide by the originally advertised itinerary.
The participant agrees that a complete assumption of risk of travel and release of AM liability is legally binding upon the signatory (below), his/her minor companion(s) under age of 21, his/her heirs, successors, assigns and legal representatives. By signing the participants confirms having read and agreed to the terms and conditions outlined by AM. This includes terms for cancellations, refunds, limited liability, and participants' responsibilities.
In the event of a dispute, it is agreed that a neutral third-party mediator will be selected in the State of Massachusetts and costs to be shared equally by each party. A failure to reach agreement would be submitted in turn to the American Arbitration Association in Boston, Massachusetts, and governed by the laws of the Commonwealth of Massachusetts. It is agreed that recovery amounts would not exceed the amount paid for the journey itself (exclusive of independently contracted travel to the destination and back). If a claim is made for an event for which AM was previously released of liability, AM will be fully indemnified for all costs (including attorneys' costs).
